1. Acceptance of Terms
By accessing, browsing, or using the Trust Union Holdings website, mobile applications, or any related services (collectively, the "Platform"), you acknowledge that you have read, understood, and agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, you must not access or use our Platform.
These Terms constitute a legally binding agreement between you ("you," "your," or "Customer") and Trust Union Holdings ("we," "us," "our," or the "Bank"), a bank registered and regulated in the United Kingdom.
2. Eligibility
Our services are open to individuals worldwide who meet the following criteria:
- Are at least eighteen (18) years of age, or the age of legal majority in your jurisdiction, whichever is greater
- Have the legal capacity to enter into binding agreements
- Are not subject to economic or trade sanctions administered by the United Nations, the United Kingdom, the United States, the European Union, or any other applicable sanctions authority
- Are not designated on any sanctions list, including the UK Sanctions List, the US OFAC SDN List, or the EU Consolidated Sanctions List
- Can provide accurate, truthful, and complete information during the registration process
- Comply with all applicable laws and regulations in your jurisdiction regarding the use of online banking services
By opening an account, you represent and warrant that you meet all eligibility requirements. We reserve the right to refuse service, close accounts, or limit access at our sole discretion where eligibility cannot be verified.
3. Account Registration and Security
a. Registration
To access our banking services, you must complete the registration process and open an account. During registration, you agree to:
- Provide accurate, current, and complete information as prompted by the registration form
- Maintain and promptly update your information to keep it accurate, current, and complete
- Complete identity verification procedures as required by applicable AML, KYC, and CTF regulations
- Agree to our Privacy Policy, which governs the collection and use of your personal information
b. Account Security
You are solely responsible for maintaining the confidentiality of your account credentials, including your username, password, and any two-factor authentication codes. You agree to:
- Create a strong, unique password that is not used for any other service
- Enable two-factor authentication (2FA) where available and recommended
- Not share your account credentials with any third party
- Notify us immediately at info@trustunionholdings.com if you suspect any unauthorised access to your account
- Log out of your account at the end of each session, particularly when using shared or public devices
Important: You are liable for all activities and transactions that occur under your account, whether or not authorised by you. We will not be liable for any loss or damage arising from your failure to maintain the security of your account.
4. Services Provided
Trust Union Holdings provides the following banking services through our Platform:
- Account Management: Savings accounts, current accounts, and fixed-term deposit accounts
- Domestic and International Transfers: Wire transfers, SWIFT payments, SEPA transfers, and interbank transfers
- Credit and Debit Cards: Issuance and management of payment cards linked to your account
- Loan Products: Personal loans, business loans, home loans, and other credit facilities
- Currency Exchange: Foreign exchange services at prevailing market rates
- Online and Mobile Banking: 24/7 access to account management, transaction history, and self-service tools
We reserve the right to modify, suspend, or discontinue any service at any time without prior notice. We will make reasonable efforts to notify customers of material changes to our services.
5. Transactions and Fees
a. Transaction Processing
All transactions are subject to processing times, limits, and applicable fees as communicated at the time of the transaction. Transfer limits may vary based on your account type, verification level, and transaction history.
b. Fees
Fees for our services are disclosed in our Schedule of Fees, which is available upon request and on our Platform where applicable. By using our services, you agree to pay all applicable fees. We reserve the right to update our fee schedule with thirty (30) days' prior notice.
c. Currency Conversion
Transactions involving currency conversion will be processed at the prevailing exchange rate at the time of the transaction, plus any applicable conversion fees. Exchange rates may fluctuate and are subject to change without notice.
d. Transaction Limits
We may impose daily, weekly, and monthly transaction limits on your account for security and regulatory purposes. Specific limits depend on your account type and verification level. You may request a limit increase by contacting customer support.
6. Prohibited Activities
You agree not to use the Platform or our services for any unlawful or prohibited purpose, including but not limited to:
- Violating any applicable law, regulation, or third-party rights
- Engaging in money laundering, terrorist financing, or other financial crimes
- Transferring funds to or from sanctioned countries, entities, or individuals
- Using the Platform to facilitate fraud, identity theft, or unauthorised access to any system
- Attempting to gain unauthorised access to our systems, other customer accounts, or any connected networks
- Interfering with, disrupting, or overloading the Platform or its infrastructure
- Using automated systems, bots, or scripts to interact with the Platform without our written consent
- Providing false, misleading, or fraudulent information during registration or verification
- Using your account for commercial purposes without our prior written authorisation
- Circumventing or attempting to circumvent any security measures, transaction limits, or account restrictions
We reserve the right to suspend, restrict, or close your account immediately and without prior notice if we reasonably suspect you are engaged in any prohibited activity.
7. Limitation of Liability
To the maximum extent permitted by applicable law:
- The Platform and all services are provided on an "as is" and "as available" basis without warranties of any kind, whether express, implied, or statutory
- We do not warrant that the Platform will be uninterrupted, error-free, secure, or free of viruses or other harmful components
- We are not liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Platform
- Our total aggregate liability to you in connection with any claim arising from these Terms or your use of the Platform shall not exceed the total fees paid by you to us in the twelve (12) months immediately preceding the event giving rise to the claim
- We are not responsible for losses caused by factors beyond our reasonable control, including but not limited to natural disasters, war, government actions, power failures, or internet disruptions
Nothing in these Terms excludes or limits our liability for fraud, death, or personal injury caused by our negligence, or any other liability that cannot be excluded or limited by law.
8. Intellectual Property
All content, design, graphics, logos, trademarks, trade names, software, and other materials on the Platform are the property of Trust Union Holdings or its licensors and are protected by applicable intellectual property laws. You may not:
- Reproduce, distribute, modify, create derivative works from, or commercially exploit any content from the Platform without our express written permission
- Use our trademarks, logos, or branding in any manner that suggests affiliation, endorsement, or partnership without our prior written consent
- Copy, scrape, or systematically extract data from the Platform for any purpose
9. Dispute Resolution
a. Informal Resolution
Before initiating formal proceedings, you agree to first contact us and attempt to resolve any dispute informally by emailing info@trustunionholdings.com. We will attempt to resolve the dispute through good-faith negotiations within sixty (60) calendar days of receiving your notice.
b. Mediation
If the dispute cannot be resolved informally, either party may refer the matter to mediation under the rules of the Centre for Effective Dispute Resolution (CEDR) or an equivalent mediation service agreed upon by both parties. The costs of mediation shall be shared equally unless otherwise agreed.
c. Arbitration
If mediation fails to resolve the dispute, either party may submit the dispute to binding arbitration in accordance with the rules of the London Court of International Arbitration (LCIA). The seat of arbitration shall be London, United Kingdom. The language of arbitration shall be English.
d. Class Action Waiver
To the maximum extent permitted by law, you agree to resolve disputes with us on an individual basis and waive any right to participate in class actions, collective actions, or representative proceedings.
10. Termination
Either party may terminate this agreement under the following conditions:
- By You: You may close your account at any time by contacting customer support, provided all outstanding obligations, fees, and transactions have been settled
- By Us: We may suspend or terminate your access to the Platform and our services at any time, with or without cause, including but not limited to: breach of these Terms, suspected fraud or illegal activity, regulatory requirements, or prolonged account inactivity
- Effect of Termination: Upon termination, your right to use the Platform ceases immediately. Any outstanding balances will be returned to you in accordance with applicable law, less any outstanding fees or obligations
Sections of these Terms that by their nature should survive termination will survive, including but not limited to limitation of liability, dispute resolution, and intellectual property provisions.
11. Amendments to Terms
We reserve the right to amend these Terms at any time. When we make material changes, we will notify you by:
- Posting the updated Terms on this page with a revised "Last Updated" date
- Sending an email notification to the address associated with your account
- Displaying a prominent notice on our Platform prior to the changes taking effect
Your continued use of the Platform after the effective date of any changes constitutes your acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using the Platform and close your account.
12. Governing Law and Jurisdiction
These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising under or in connection with these Terms that are not resolved through the dispute resolution process described in Section 9 shall be subject to the exclusive jurisdiction of the courts of England and Wales.
If you are accessing our services from outside the United Kingdom, you do so on your own initiative and are responsible for compliance with local laws applicable to you.
